RIGHTFUL REJECTION OF GOODS BY BUYER--DEFINITION OF CURABLE DEFECT
For purposes of this agreement, a defect shall be deemed curable by seller only if seller in fact would be able to effect a cure of the defect within days after notice of rejection, and not if the defect, without regard to the capacity or ability of seller to perform, is one that could be cured within a stated or a reasonable time.
This is a UCC-buying and selling form.
It is intended to be an addendum to other forms.
